1. Scope and Contracting Parties
(1) These General Terms and Conditions (AGB) apply to all contracts concluded between DxE Atelier (hereinafter referred to as “Seller”) and a consumer within the meaning of §13 BGB (German Civil Code) via the online shop at www.dxeatelier.de.
(2) Consumers are natural persons who enter into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
(3) By placing an order, the customer accepts these Terms and Conditions.
(4) Any deviating terms and conditions require the express written agreement of the Seller.
2. Conclusion of Contract
(1) Product listings on the website are non-binding and constitute an invitation to place an order.
(2) The order becomes binding when the customer clicks the “Complete order” button.
(3) The Seller confirms receipt of the order by email. This confirmation does not yet constitute acceptance of the contract.
(4) A contract is concluded when the Seller explicitly confirms the order or dispatches the goods within 7 days.
(5) In the case of errors (e.g. pricing or typographical), the Seller reserves the right to cancel the order. Any payments made will be refunded immediately.
3. Prices and Payment
(1) All prices include German VAT at the applicable statutory rate (currently 19%).
(2) Shipping costs are shown separately on the product page.
(3) Accepted payment methods are bank transfer, credit card, and PayPal.
(4) Payment is due upon conclusion of the contract unless otherwise agreed.
4. Delivery Conditions
(1) All products are custom-made to order and will be shipped to the address provided by the customer.
(2) Delivery times are indicated on the product page.
(3) If a product is unexpectedly unavailable, the customer will be notified immediately, and payments will be refunded.
(4) In the event of delays due to force majeure or reasons beyond the Seller’s control, delivery time will be extended accordingly. If the delay lasts more than four weeks, either party may withdraw from the contract.
(5) For consumer purchases, the Seller bears the risk of loss or damage during shipment.
5. Retention of Title
Goods remain the property of the Seller until full payment is received.
6. Right of Withdrawal
(1) Legal Right of Withdrawal
Consumers residing in the EU have the right to withdraw from the contract within 14 days without providing a reason.

(2) Withdrawal Period
The withdrawal period is 14 days from the day you or a third party named by you (other than the carrier) receives the goods.
(3) No Right of Withdrawal for Custom Goods
There is no right of withdrawal for custom-made or personalized items (e.g. made-to-order hats) according to §312g (2) BGB.
7. Returns and Exchanges
(1) As all items are custom-made, returns and exchanges are not possible, unless the product is defective.
(2) In case of defects or damage, we will replace the item and provide a free return label.
(3) Please do not return items freight collect (cash on delivery). Contact us for return instructions.
8. Warranty
(1) The statutory warranty rights (§§ 434 ff. BGB) apply to consumers.
(2) Improper care or misuse of the product voids the warranty. Care instructions are provided on our website.
(3) Visible damages or defects should be reported to us immediately.
9. Liability
(1) The Seller is liable for injury to life, body or health in accordance with statutory provisions.
(2) For other damages, the Seller is only liable for willful misconduct or gross negligence.
(3) In cases of simple negligence, liability is limited to foreseeable damage typical for this type of contract.
(4) Liability under the German Product Liability Act (ProdHaftG) remains unaffected.
10. Data Protection
Personal data is processed in accordance with the EU General Data Protection Regulation (GDPR). Please refer to our Privacy Policy.
11. Applicable Law and Jurisdiction
(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the customer is a consumer, this choice of law does not affect mandatory consumer protection laws of the country in which the customer resides.
(3) If the customer is a merchant, the exclusive place of jurisdiction is Saarbrücken, Germany.
